Terms & Conditions of IRODORI GmbH

 

1 – General
The following terms and conditions shall govern the sale by IRODORI GmbH (named “we/us”) and the buyer (named “you”). Any terms and conditions that you propose or object to are subject to our written consent. By placing an order with us, it is deemed that you have read, understood and agreed to our Terms and Conditions. Deviating conditions set by you are not accepted.

We reserve the right to add, delete or amend these Terms and Conditions without prior written notice at any time, at our sole discretion.

2 – Contract
As soon as you have filled in the order form and confirmed your order with the „BUY“ button, a contract between you and us is established in accordance with the conditions below (Prices, Shipping, Transaction fees etc.) without a separate fulfilment confirmation from us.

The placed order and chosen conditions are representative for the delivery of our products. The prices and conditions shown at the time you placed the order and confirmed with “BUY” apply.

3 –Product
Please note that the actual colours, size, structure and finishing you see online may deviate in fact, because our products are made of natural materials and are handcrafted. Corresponding inequalities of material and colour are possible.

Decoration articles on the photos do not constitute part of the offer. Accessories and decoration articles have to be bought separately.

4 – Prices and Payment
Prices are listed in Swiss francs (CHF) incl. VAT and are accordingly shown in the shopping cart.

The price is determined in accordance with the order date. All prices are subject to change by IRODORI GmbH without notice.

Deliveries are only made after successful receipt of payment by accepted methods of payment as Visa, MasterCard, Postcard and via advance payment (bank transfer). Depending of the method of payment you chose the following transaction fees can arise (the costs will be shown at the payment process):

MasterCard:      3 CHF
Visa:                    3 CHF
Postcard:           3 CHF
bank transfer:  free of charge

If the shipping address is located outside of Switzerland, you will be charged no Swiss VAT, but the destination country’s applicable import duty and sales tax.

Discounts and vouchers will only be applied when it fulfils the conditions. The voucher code has to be filled in with the completion of the order. Unclaimed discounts cannot be given in retrospect. Discounts cannot cumulate or be reimbursed in cash.

5 – Delivery

The following delivery times are valid without obligation for the regions listed below (working days Monday–Friday):

Switzerland:
9 CHF 3-4 working days

Europe:
up to 2 kg: 24 CHF 4-10 working days
from 2 kg: 45 CHF 4-10 working days

Rest of the World:
up to 2 kg: 32 CHF 15-20 working days
from 2 kg: 53 CHF 15-20 working days

For deliveries to any place outside of Switzerland, duty, sales tax and import taxes may apply. These must be paid by the recipient upon delivery of the order.

To pick up the order at the head office is free of shipping cost. Customers will be informed as soon as the order is ready at the head office. The order will only be handed over if the customer can show the printed form of the order confirmation.

The parcel cannot be delivered because of an incomplete or lacking delivery address, because of a long lasting absence or if the customer does not collect his parcel, the additional charges for a second shipping have to be borne by the customer; they have to be paid in advance before the second shipping takes place.

6 – Your rights of Return
We accept returns without indication of any reason within 14 days from shipping date. Shipping charges, Duties, taxes and other expenses are not reimbursed by us.

The return of any product shall be effected at the buyer’s risk and expense to the following address:

We will control all returned products. All goods must be returned in perfect condition without signs of usage. The cost of shipping has to be borne by you for this kind of return. We will refuse reimbursement of the returned product if:
– The product shows signs of visible use
– The product is damaged as a result of return transportation

We reimburse your payment (excluding duties, taxes and other expenses not charged by us). In case of return, we will not reimburse shipping charges. The refund of the sale price will be carried out in the same manner as the original payment was made. If you used the pre-payment method to order, we would ask you to indicate your banking details.

If the product is in any way faulty or does not conform to the order placed with us, we will refund the purchase price paid, the return shipping cost; any customs, duties and goods taxes (upon proof of payment i.e. a receipt), plus the original shipping costs. Likewise, no good will be taken back if it shows signs of damage or interference, such as:
– Events out of our control e.g. natural disasters
– Signs of improper use
– Interference by the customer or a third person
– Extreme use or extreme influence by the customer

No cost will be covered should the product/s go missing during the return shipping. We advise you to send all items back with a transport firm which provides a track & trace service.

7 – Our right
If you supplied us with incorrect information about your creditworthiness we reserved the right to withdraw from the contract in whole or in part.

8 – Reservation of proprietary rights
The goods shall remain our property until you have fully paid any and all debts as of the contracting date, including the current account balance if any.

9 – Warranty
In the case of a material defect in the product on our behalf, you have the right to choose a similar product in exchange, to withdraw from the contract or to request a price reduction within 12 months from the purchase date. All requests are to be confirmed by written correspondence with us at info@irodori.ch..

It is up to you to control the products either upon delivery and to notify us within the time period mentioned in above. Failure to do so will result in a loss of your rights.

Other claims for damages and indemnity are ruled by the provisions of Swiss law and we are only liable for gross negligence and intent. This includes our employees or other helping persons. Binding law terms (i.e. law of product liability) are not affected.

10 – Secure Transactions
Secure Transactions – Our e-commerce system uses SSL (Secure Sockets Layer) – the industry standard for encryption technology used to create a secure transaction environment for commerce on the Internet. Each transaction will be authorised by the involved credit or debit card company. Blocked or false credit or debit cards cannot be used. We commit ourselves not to pass on any customer data for advertising purposes to third parties, neither for free nor against payment. The only exception is to pass the data for logistical reasons (ie. shipping companies)

11 – Copyrights
The copyright to the design of our website and to its contents, including but not limited to texts and graphics, is held entirely by IRODORI GmbH. Without our prior written consent, it shall not be permitted to copy, download or otherwise use any part thereof for one’s own purpose. Excepted are our special links which are offered for downloading.

12 – Miscellaneous Terms
For customers in Switzerland: All terms and contracts under this agreement are governed by Swiss Law without regard to conflict of laws. UN purchasing law (CISG) is excluded. The designated court is Zurich, Switzerland.

For other Customer: All terms and contracts under this agreement are governed by Swiss Law without regard to conflict of laws. UN purchasing law (CISG) is excluded. The designated court is Zurich, Switzerland, if it is allowed to choose a court of jurisdiction. This does not apply for compulsory law of the country in which the customer has its common residence.

Should a provision of these general conditions of supply prove to be wholly or partly invalid, the parties to the contract shall jointly seek an arrangement having a legal and economic effect which will be as similar as possible to the invalid provision.
